Calculation Methodology & Legal Framework in Spain
Settlement (finiquito) calculations in Spain are governed by the Workers' Statute (Estatuto de los Trabajadores, Royal Legislative Decree 2/2015). The final settlement encompasses unpaid earned salary for the final month (Article 26 ET), compensation for accrued and unused holiday days (Article 38 ET), and accrued extra payment bonuses (Article 31 ET). In addition, statutory severance compensation is determined according to the specific legal cause of contract termination under Articles 49.1(c), 53.1(b), and 56 ET. Accrued and unused annual holidays compensated upon termination are subject to complementary settlement and contribution in accordance with Article 147.1 of the General Social Security Act (LGSS) (L13 settlement in the RED/TGSS system).
Statutory compensation for fixed-term contract expiry is calculated proportionally using actual calendar days of service under Spanish employment law. The monthly rounding used for certain dismissal compensations does not apply.
